User Agreement

 

1. Scope of application and subject

1.1. This user agreement applies to the use of the alumni portal "robealumni-ae.ch" of the Rochester-Bern Executive Programs office (hereinafter referred to as RoBe), Hochschulstrasse 4, 3012 Bern (hereinafter referred to as RoBe Alumni/-ae) and alumni/-ae of RoBe.

1.2. By using the Alumni Portal, these terms and conditions are expressly deemed to be agreed.

2. RoBe alumni/-ae services

2.1. RoBe Alumni/-ae offers users the use of the password-protected online platform ("robealumni-ae.ch"), which includes profiles, a job and company portal, and event management with a modern search function.

2.2. Users can use the alumni portal as an online network and communication platform. Contributions and topics can be published in various groups. The purpose of the alumni portal and its communities (groups) is to enable interdisciplinary and interfaculty exchange and networking as well as access to relationships and experiences with high professional and emotional value.

2.3. RoBe Alumni/-ae reserves the right to change and expand the content and structure of the alumni portal if this does not or only insignificantly affect the fulfillment of its purpose.

2.4. RoBe Alumni/-ae is entitled to interrupt access to the digital services of the Alumni Portal for a reasonable period of time for important reasons, such as service and maintenance work.

3. Conditions of use

3.1. In order to receive services on the alumni portal, users must be registered on the alumni portal and have set up a profile. There is no legal claim to activation of the profile by RoBe Alumni/-ae.

3.2. The prerequisite for using the groups is joining the corresponding community. There is no legal claim to activation or participation in a particular community.

4. Duties of the users

4.1. Users are obliged to provide truthful information.

4.2. Users must keep their access data (user name, password, etc.) secret and not disclose them to third parties. In case of loss of the access data or in case of suspicion of use by an unauthorized person, the users are obliged to inform RoBe Alumni/-ae immediately so that the access can be blocked as soon as possible.

4.3. The use of the services and templates offered in the Alumni Portal is intended for the users' own purposes and personal use only. The transfer of data and information to third parties against payment or free of charge is not permitted.

4.4. Users undertake to store, publish, transmit and distribute only content, including photos, images, text, representations or videos, which they are authorized to pass on, or not to copy, distribute and transmit accessible data without the express consent of the respective rights holder or to read these with technical aids. Users refrain from using trademarked words and Internet addresses as their user name (nickname). The data protection guidelines and the general terms and conditions of RoBe must be observed in connection with this user agreement.

4.5. In particular, users are prohibited from publishing insulting or untrue content, from sending spam to other users via the system, from engaging in anti-competitive activities, from posting a topic more than once in the groups (prohibition of double postings), from publishing third-party press articles in the groups without the consent of the author, or from advertising in the groups without the express written consent of the provider. This also applies to so-called surreptitious advertising, such as in particular the linking of one's own homepage with or without posting text in the signature or within posts. Homepage URLs and address or contact data may only be published in the user profile of the groups.

4.6. Users are not allowed to interfere with the network of RoBe Alumni/-ae by technical or electronic means, especially hacking attempts, introducing viruses/worms/Trojans and other attempts to interfere with the software and hardware of the university.

4.7. In the event of a violation of the aforementioned obligations, RoBe Alumni/-ae may also impose the following sanctions on users, irrespective of termination: Deletion or modification of content that users have posted, issuing a warning or blocking access to the communities (groups). The blocking of access to the groups is possible if there is sufficient suspicion that the users in question are violating these terms of use. The users can avert these measures if they dispel the suspicion by presenting suitable evidence at their own expense. RoBe Alumni/-ae reserves the right to take legal action, e.g. compensation for damages caused by users, etc.

5. Utilization rights

5.1 By agreeing to this User Agreement, you expressly acknowledge that the Alumni Portal of the University of Bern contains information, texts, software, images, videos, graphics, sound and other materials that are protected under property and intellectual property law (e.g. by means of copyright, trademark or patent protection). You also acknowledge that you only acquire a non-exclusive right of use and no ownership rights to the materials on the Alumni Portal.

5.2 The use of information and materials is generally subject to the intellectual property and data protection laws of the federal government and the canton. Users are personally responsible if they upload copyrighted works to the alumni portal and make them accessible to third parties.

6. Liability and warranty

6.1. RoBe Alumni/-ae endeavors to offer the alumni portal for retrieval as trouble-free as possible. Claims for damages due to a failure of the alumni portal or non-accessibility of individual contents of the users or other service disruptions are excluded, unless RoBe Alumni/-ae is responsible for these due to intent or gross negligence. Liability for lost profits, lost savings, lost or altered data, indirect damages, as well as damages from third party claims are also excluded, insofar as this does not conflict with mandatory law.

6.2. RoBe Alumni/-ae is not liable for damages caused by misuse or incorrect use of the provided data, by incomplete or incorrect information as well as by disregard of the duties of care stipulated in the user agreement by the users. Liability for damages caused by third parties gaining knowledge of the user name and password due to the user's lack of due diligence is also excluded.

6.3. Neither RoBe Alumni/-ae nor third parties guarantee in any way a certain accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Alumni Portal for any particular purpose. In particular, RoBe Alumni/-ae does not guarantee the correctness of the contributions published in the groups. Users acknowledge that such content, information and materials may contain inaccuracies or errors. Any liability that can be derived from this is expressly excluded to the extent permitted by law.

6.4. RoBe Alumni/-ae also does not warrant that the Alumni Portal and their server is free of computer viruses or other harmful mechanisms.

6.5. The links used on the alumni portal are for further information. They do not imply that the linked pages are endorsed by RoBe Alumni/-ae and the latter is not responsible for the content.
